1. About us and these terms
These terms apply to your use of our website [no64store.com] and to any orders you place with No.64 (“we”, “us”, “our”), whether online or in our shop at 64 Dyke Road, Seven Dials, Brighton. By using our website or placing an order, you agree to these terms. Please read them carefully.
Nothing in these terms affects your legal rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.
2. Our products
We sell curated gifts, jewellery, accessories, homeware and prints, many from independent makers. We take care to describe and picture our products accurately, but slight variations in colour, texture, size and finish are natural particularly for handmade and one-of-a-kind pieces, where small differences are part of their character and not a fault.
Many of our pieces are unique or made in very limited numbers. This means an item may be unavailable or sell out quickly, and we cannot always guarantee a replacement.
3. Placing an order
When you place an order online, you’ll receive an acknowledgement email confirming we’ve received it. This acknowledgement is not acceptance of your order — a contract between us is formed only when we send you an email confirming that your order has been dispatched.
We reserve the right to decline or cancel an order for example, if an item is out of stock, if there has been a pricing or description error, or if we’re unable to fulfil it. If we cancel an order you’ve paid for, we’ll refund you in full.
4. Prices and payment
Prices are shown in pounds sterling and include VAT where applicable. Delivery charges, where they apply, are shown at checkout before you pay.
We try to ensure all prices are accurate, but errors can occur. If we discover an error in the price of something you’ve ordered, we’ll contact you before dispatch to ask whether you wish to continue at the correct price or cancel. Payment is taken securely through our payment providers at the time you order. We do not store your full card details unless you expressly grant permission under a membership/ subscription programme.
5. Delivery
We deliver across the UK by tracked post. Delivery charges and options are shown at checkout.
Delivery is complimentary on orders over £40 (over £30 during our introductory period). We aim to dispatch orders within 1-2 working days and to deliver within 2-3 working days of dispatch, but these are estimates and not guarantees. Once we’ve dispatched your order, delivery times are in the hands of the carrier.
Risk in the goods passes to you on delivery. If an order arrives damaged, please contact us at hello@no64store.com within a reasonable time, with your order number and a photo, and we’ll put it right.
6. Returns and refunds: Online orders
We want you to love what you buy. In addition to your legal rights, we offer a 30-day returns window on online orders: you may return most items within 30 days of receiving them, in their original, unused condition and packaging, for a refund or exchange.
Your legal right to cancel. For most online purchases, you also have a statutory right under the Consumer Contracts Regulations to cancel within 14 days of receiving your order, for any reason, and receive a refund. Our 30-day policy is a goodwill extension of this and does not reduce your statutory rights.
How to return. To return an item, contact us at hello@no64store.com within 30 days of your order date and we’ll explain how. Unless an item is faulty or not as described, you are responsible for the cost of returning it, and we recommend using a tracked service as returns are your responsibility until they reach us. We’ll process refunds within 14 days of receiving the returned item (or of you providing proof of return), to your original payment method.
One-of-a-kind and bespoke pieces. Genuinely unique, personalised or made-to-order pieces are non-returnable and non-refundable unless they are faulty or not as described, as they are made or selected specifically and cannot be resold. This does not affect your rights in respect of faulty goods. Where this applies, it will be made clear on the product page.
Items that can’t be returned. For hygiene reasons, certain items (such as earrings for pierced ears) cannot be returned once opened unless faulty. Any such exclusions will be noted on the product page.
7. Returns: in-store purchases
Purchases made in our shop are not subject to the 14-day online cancellation right, which applies only to distance (online) purchases. For in-store purchases, we will always honour your legal rights in respect of faulty, damaged or misdescribed goods, you’re entitled to a refund, repair or replacement in line with the Consumer Rights Act 2015.
We do not offer refunds or exchanges on in-store purchases simply because you’ve changed your mind, though we may do so at our discretion as a goodwill gesture. If you’d like to discuss a purchase, please bring your receipt and speak to us in store.
8. Faulty goods
If something you’ve bought from us either online or in store is faulty, not as described, or not of satisfactory quality, you have rights under the Consumer Rights Act 2015, which may include a refund, repair or replacement. Please contact us at hello@no64store.com (online) or bring the item and your receipt to the shop, and we’ll put it right. These rights are in addition to, and not affected by, our returns policy above.
9. Club 64 loyalty programme
Club 64 is our loyalty programme. Membership is free. Members earn points on purchases and may receive member benefits such as early access and event invitations. Points have no cash value, cannot be exchanged for cash, and may be subject to conditions or expiry, which we’ll make clear. We may change or end the programme, or a member’s participation, where we reasonably need to. We’ll give notice of significant changes where we can. Full details are set out on our Club 64 page.
10. Your account
If you create an account, you’re responsible for keeping your login details secure and for activity under your account. Please let us know promptly if you think your account has been used without your permission.
11. Use of our website
You may use our website for lawful purposes only. You must not misuse it, attempt to gain unauthorised access, or use its content (images, text, branding) without our permission. All content on the site, and the No.64 name and branding, belong to us or our makers and are protected by intellectual property rights.
12. Our liability
We don’t exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breach of your statutory consumer rights. Otherwise, we’re not liable for losses that were not foreseeable, or that arise from circumstances outside our reasonable control. Nothing in these terms affects your statutory rights.
13. Privacy
We handle your personal information in line with our Privacy Policy and Cookie Policy, which explain what we collect, how we use it, and your rights.
14. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the one published when you place it. The latest version will always be on this page, with the “last updated” date above.
15. Governing law and disputes
These terms are governed by the law of England and Wales, and any disputes will be subject to the courts of England and Wales. If you have a concern, please contact us first at hello@no64store.com we’d always rather put things right directly.
